Section 21 Notices enable landlords to ask their tenant to leave without the need to give a reason, with a minimum of a two month notice period.

Problems with the court system

According to The National Landlords Association, many landlords were being forced to go down the Section 21 route, as they had little confidence in the alternative option which is to pursue an eviction through the courts, under Section 8.

One major problem encountered by landlords using the Section 8 Notice is that, if a claim is made on the basis of rent not being paid, a claim could be struck out if the tenant decides to pay their rent right at the last minute. Furthermore, without good evidence as to the items in the property the court may decide to throw out a claim. Landlords have ended up with unrecoverable costs and time wasted, only for the tenant to fall into arrears again or damage property again leaving landlords with no option but to either start the court process under Section 8 again or to go down the Section 21 Notice route. The Section 21 Notice is therefore a more popular method of bringing a tenancy to an end.

Many are of the opinion that the court system under Section 8 needs to be worked on in order to become more efficient, especially as no fault evictions will be banned.

Confusion and anger

This new development has resulted in a lot of anger amongst the landlord community, who feel that the system has been disproportionately biased towards the tenant. However, Section 21 Notices have been known to be used as revenge.

Although this is expected to provide tenants with more security, it remains to be seen how this change will impact the rental market.
